Dans le cadre d’une consultation pour un accord-cadre de travaux, lancée par une métropole, le règlement de la consultation prévoyait que le mémoire technique devant contenir l’ensemble des éléments liés aux sous-critères affichés. Pour l’un des candidats, la collectivité a jugé que le mémoire était très insuffisant et a jugé l’offre irrégulière. L’entreprise conteste l’élimination de son offre sur ce simple fait.

Les juges, dans un jugement relativement sévère, vont donner raison à l’administration : « le mémoire technique ne comporte pas l’intégralité des éléments demandés par l’acheteur pour l’appréciation de l’ensemble des critères. […] L’offre de la société ne comportait donc pas l’ensemble des éléments exigés par les documents de la consultation et nécessaires à l’appréciation de son offre. Elle est ainsi incomplète et non, comme le soutient la société, insuffisante au regard des exigences du pouvoir adjudicateur ».
