Dans une consultation de travaux en procédure adaptée, lancée par l’Etat, l’avis a été publié le 1er décembre 2020 pour une date limite de remise des offres le 15 décembre, avec (qui plus est) une visite du site obligatoire. Un des candidats non retenus, n’ayant pu effectuer la visite que le 10 décembre 2020, et donc bénéficié que d’un délai très court de réponse, a décidé d’introduire un recours.

Les juges vont effectivement lui donner raison, considérant que « compte tenu de l’ensemble de ces éléments, la requérante est fondée à soutenir que le délai laissé aux candidats pour soumissionner à l’attribution du marché en litige était insuffisant pour assurer le respect des principes de liberté d’accès à la commande publique, d’égalité de traitement des candidats et de transparence des procédures ».
