Dans le cadre d’une consultation, l’acheteur avait exigé la remise d’échantillons. Jusque-là, la situation est classique… Toutefois, à l’ouverture des plis, l’acheteur ayant constaté l’absence des échantillons d’un des candidats, il élimina directement son offre. Cette entreprise a décidé d’ introduire un recours devant les tribunaux, affirmant qu’ils avaient bien été déposés par un transporteur et produisant un bon de livraison.

Les juges ne vont pas lui donner raison, rappelant que la livraison des échantillons devait se faire (selon le règlement de consultation) dans un bureau bien identifié, avec la remise d’une attestation de dépôt. La société ne produisant qu’un bon de livraison (non l’attestation demandée), c’est à bon droit que son offre a été déclarée irrégulière car incomplète.
